But for it to be “illegal” there would have to be legal repercussions from the state and those aren’t mentioned. So it’s just breach of contract with a supplier, not breaking an actual law.

Being a small farmer is rough. Farming land is expensive, equipment is also expensive and on top of that the seed companies are not easy to deal with. I know farmers that own their own land and have second jobs to make ends meet.

Hybrid crops grow bigger and faster. For table crops, they taste better. They are more resistant to disease.

Why I plant heritage corn from Mexico. Every season I get 100’s of lbs of seed corn that I use for the next years harvest. Thankfully, I’m not a commodity grower, but man…what a travesty. We’ve strayed so far from where we came from. The corn I grow isn’t sweet corn, or what we’ve grown up with to eat. It’s used for meal, or feed for our neighbors livestock. We trade, and it’s been a lovely community project in self-sufficient farming. I feel bad for those folks who don’t have an option to do this, and are locked into a system that forces them to sign contracts with these large seed companies. I think we’re getting close to the breaking point of they system.

Stop associating Agricultural bankruptcy with regular Chapter 11 bankruptcy, they are not the same.
Farmers do not go under Chapter 11 bankruptcy they do Chapter 12 bankruptcy which is a special form of bankruptcy for the agricultural industry it is a highly protected form of bankruptcy and offers unique advantages like higher debt limits, no creditor voting, easier asset sales, options to reduce secured debt and restructuring.
It is a highly privileged form of bankruptcy to protect the agricultural industry because farming is generally considered a high-asset, low-margin business. Farms go bankrupt all the time but they have certain protections that allows them to bounce back much easier than most. If these bankruptcy privileges didn’t exist in the farming industry the entire farming industry would been gone a long time ago.
