This has always been true. I realized this in the wake of the 2000 election. All it requires is that enough justices consider themselves unconstrained by the constitution.
With the shadow docket they don’t even need to concoct a rationale.

Clarence eyeballing a slightly used “motor coach” and the rich guy jingling the keys and winking at him. Alito dreaming about beating minorities, including Clarence, and a pure bred white Christian ehtnostate.
And not a single one of them likes Trump and actually fucking hates him, but he ain’t the boss they answer to.
