      The Emmett Till Antilynching Act was created after over 200 attempt’s a similar bill had failed.

      I mean it’s been outlawed for a while. Adding ‘federal’ to it is just a matter of jurisdiction

      People just got away with it bc jury nullification (so in theory it’s still possible today)

      “Hate” crime is a stupid designation, giving outsized influence to attitudes when it comes to judging a crime. Lynching was a crime long before, under the designation “murder”.

      Something not being a specific crime and something not being a crime are two different things.

      Lynching necessarily involves the practicing of multiple crimes in order to be commited. The difference is that instead of being charged of assault or murder under the circumstances of a lynching, now you will be charged with lynching as an independent crime.
