I’m also curious about the legality specifically of having a fee that can be removed if asked but is automatically applied to everyone else’s checks…seems even shadier than traditional (but still BS) “price of goods fees”

This reminds me of the episode of Malcolm in the middle where Lois realises they’ve been paying a service charge as well as tipping at their favourite pizza place. Boycott ensues with the boys of the family sneaking off to eat pizza in the garage only for Lois to then show up moments later with more pizzas she’s brought as a surprise.

CNF is Concession/Franchise Fee. A bullshit 5% fee added just because they know most people won’t notice.

In the UK we have a 10-15% discretionary service charge. It’s pretty much a forced tip and you can request to remove it.
One of the reasons they don’t fold it in with the regular prices is that a discretionary service charge is not subject to Value Added Tax (VAT) because it is considered a voluntary payment
