      I learned the hard way during COVID to no longer tie my name to my employer. I still chuckle when I get the spam clearly coming from LinkedIn search results saying “We’ve heard great things about you from your colleagues at Available Upon Request and have a special offer for you”

McPherson (1987), the Supreme Court decided that a public worker’s offensive remark about President Reagan after an assassination attempt was still protected by the First Amendment. The Court explained that speech can be crude or unpopular, but it is protected as long as it isn’t a true threat, an incitement to violence, or something that disrupts government work.

      The same principle applies after the Charlie Kirk shooting. People may strongly dislike the comments being made, but unless those comments cross the legal lines of threat or incitement, they are protected free speech.

      Free speech matters most when it protects views that are unpopular or uncomfortable. That’s the real test of the First Amendment.
