The Court explained that speech can be crude or unpopular, but it is protected as long as it isn’t a true threat, an incitement to violence, or something that disrupts government work.
The same principle applies after the Charlie Kirk shooting. People may strongly dislike the comments being made, but unless those comments cross the legal lines of threat or incitement, they are protected free speech.
Free speech matters most when it protects views that are unpopular or uncomfortable. That’s the real test of the First Amendment.
