    2. It’s becoming increasingly clear to me people are generally under the impression invoking the 25th Amendment would work to see Trump (or really, any president) removed from office, but I’m fairly certain that isn’t so – at least not right now.

      Under our current two-party system, with a severely divided Congress, invoking Section 4 would last as long as it took Trump (or any CiC) to write down “Naw, I’m good” and tweet it at the House and Senate, since neither of those bodies will ever realistically meet the 2/3rds vote threshold required to actually remove the president and install the VP in his place.

      25th Amendment, section 4

      “Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.
           
      Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive department or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office. Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.”

      The only way it works right now is if about half the GOP abandons MAGA and all the Dems join in. I don’t see it happening unless he has a massive stroke and can’t physically do the job. Maybe not even then – I don’t think Trump’s people will want to cede power to Vance’s people.

    6. I’m curious what your thought process is, OP.

      Trump is a piece of shit, in my view, and he’s been cognitively diminished since I can remember.

      And while I agree this decision is inflammatory and a step backwards on the nuclear issue, I don’t see how it’s connected to invoking the 25th.

      In what way does saying we should resume nuclear testing mean he is incapacitated or disabled to the point that he must be removed from office (the part of the 25th I’m assuming you’re referring to)?

      We’ve done nuclear weapons testing under a number of presidents — from Truman to Bush Sr. It was only halted (in terms of explosive testing) in 1992. It seems to me, admittedly a total layman, like a thing that can be useful in some ways, even if I think it ultimately does more harm than good.

      I’m just not seeing the connection between “we’re going to test nukes again” and “Trump is no longer capable of holding the office of the President.” How would you frame it if you were, say, presenting a resolution to Congress?
